Terms of Service

Tomako is a web-based GTM operating system and public tool workspace. It helps users organize product context and generate naming ideas, brand directions, launch assets, listing drafts, content drafts, research reports, checklists, visual prompts, and growth materials.

Some public tools are free. Paid plans may provide account-based access, credits, saved workspace features, higher limits, faster processing, exports, or other digital services described at checkout or on the pricing section of the site.

Input means content you submit to Tomako, including prompts, product descriptions, URLs, files, screenshots, brand assets, and reference materials. Output means AI-assisted or software-generated text, images, prompts, reports, lists, files, or other materials returned by Tomako.

You keep ownership of your Input. You grant Tomako the rights needed to host, process, transform, display, transmit, and store Input and Output to provide, secure, troubleshoot, and improve the service.

Subject to these Terms, applicable law, and third-party rights, you may use Output for your business or personal brands. Output may not be unique, may resemble output generated for other users, may not be copyrightable, and may require human review before publication or commercial use.

You are responsible for ensuring that your Input and your use of Output do not violate law, platform rules, third-party intellectual property rights, publicity rights, privacy rights, confidentiality duties, or contractual obligations.

Tomako outputs are drafts and suggestions. They may be inaccurate, incomplete, outdated, biased, unsafe, unsuitable for your audience, or inconsistent with platform requirements. You are responsible for reviewing, testing, editing, and approving outputs before publishing, submitting, paying for distribution, or relying on them.

Tomako does not provide legal, financial, tax, medical, investment, hiring, security, regulatory, or other professional advice. Seek qualified professional review when outputs affect regulated, high-risk, or legally sensitive decisions.

Tomako is an evolving product. Some features may be experimental, beta, preview, limited, or free-to-try. We may modify, suspend, limit, or discontinue features, models, integrations, credits, storage, or access levels as the service changes.

We do not guarantee uninterrupted availability, exact repeatability of AI outputs, permanent storage of generated content, or support for every browser, region, model, integration, or third-party platform. Keep your own copies of important outputs.

Plans may include credits, generation limits, rate limits, storage limits, model-access limits, export limits, or fair-use controls. Limits may be shown in the product, at checkout, or in account notices.

We may throttle, limit, suspend, or review usage that is excessive, automated, abusive, risky, unpaid, technically harmful, or inconsistent with the plan purchased. Additional usage may require an upgraded plan or additional payment.

Refund, cancellation, and digital delivery terms are part of these Terms and are available at /refund-cancellation-policy and /shipping-delivery-policy.

Tomako may rely on third-party infrastructure, payment processors, analytics, email, storage, AI model providers, platform APIs, and integrations. Third-party services may have their own terms, availability, limits, prices, and data practices.

If you connect a third-party account, import a URL, submit a file, or use an integration through Tomako, you are responsible for having the rights and authorization needed to do so.

If you believe content generated or hosted through Tomako infringes your rights, contact support@tomako.ai with enough detail for us to review the claim. We may remove content, restrict access, suspend accounts, or take other action when appropriate.

Tomako is provided on an as-is and as-available basis. We do not guarantee that outputs will be accurate, complete, lawful for your situation, original, copyrightable, accepted by any platform, or suitable for any specific business result.

Nothing in these Terms limits non-waivable consumer rights or other rights that cannot be excluded under applicable law.

To the maximum extent permitted by law, Tomako and Mindful Go LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or the cost of substitute services arising from use of the service.

We may suspend or terminate access if we believe you violated these Terms, created risk for Tomako, users, payment partners, or third parties, failed to pay, triggered fraud or chargeback concerns, or used the service unlawfully. You may stop using Tomako at any time and may request account deletion through support.

We may update these Terms as the service changes. The latest version will be posted on this page with the last updated date. Continued use of Tomako after an update means you accept the updated Terms to the extent permitted by law.
